This privacy policy is concerned with your use of the online information services provided by Zappa. It also clarifies our cookies’ policy and usage.

The service provided by Zappa allows vendors and landlords to present their properties, and potential/existing clients access to the details provided with the exhibited properties. Zappa is not an estate agency.

What our Privacy Policy Covers

This Privacy Policy explains how Zappa collects, uses and protects any of your personal information that its sites obtain. This policy is restricted to the practices of companies owned or controlled by Zappa, and all Zappa emplyees.

Zappa retains the right to modify or repost this Privacy Policy at any time, without notice. Any such modifications or replacements will have immediate effect upon the posting of the modification or replacement Privacy Policy on its sites.

Use of any of the Zappa sites is an agreement to the terms of this policy and any future modifications or amendments. It is also an agreement to review this Privacy Policy regularly to be aware of any such modifications or amendments.

Zappa uses your personal information to: 
- improve Zappa’s features and services. 
- help members provide more personalised services.

Personal information collected: When you visit, register or use the services on its sites, Zappa may ask you to provide certain personal information, including your name and your contact details. Zappa may also collect information about your use of the sites including IP address, searches, times and date of site access, properties viewed, agents or developers contacted, including contents of the emails you send them and any other information that you may upload to Zappa sites. Finally, Zappa may also collect information from any of your correspondence with us.

Information collection and use

Your information allows Zappa to provide you with full access to the sites, and supply the best services and features appertaining to your request. Zappa may collect information to identify patterns for use in marketing. This helps us develop, administer, support and improve Zappa’s services and features. With your consent to contact you, we may do so for your views on our services, and to notify you occasionally about important changes or developments to the sites or our services. With your consent, Zappa might also use your information to email you with details about any other products or services on offer that may be of interest. The following features, by their nature, require and make use of personally identifiable information;


Sending emails 
Zappa records the information you complete on the 'Email Advertiser' forms on the Sites. Zappa then sends it to the advertiser you wish to contact. This helps the advertiser provide you with a personalised service. 

Email a Friend 
When you use the 'email a friend' feature, we record which properties you have forwarded, solely to monitor their popularity. We record any other details provided in the email for internal evaluation of service. We do not add any information collected in this manner to our mailing lists.

Registering with us 
You do not need to register with us to visit our Sites. If you do, Zappa saves the details and uses them to personalise its service to you. You can update your details at any time via the Sites or by emailing us at hello@zappa.ie

Who has access to the information you provide or we collect?

Zappa retains access to all your collected personal information. If you have consented on signup or on the appropriate email form, Zappa may provide any collected information to thoroughly screened third parties to contact you about products or services we believe may be of interest. If you change your mind about being contacted by third parties, please email us at hello@zappa.ie with a request to opt out.

If Zappa enters into a joint venture with, or is sold to or merged with another business entity, your information may be disclosed to our new business partners or owners.

Zappa uses third-party analytics services to help understand use of our services. Google Analytics combines information from Google's interest-based advertising or third-party audience data to provide approximate demographic information.

Zappa does not otherwise disclose, sell or distribute personally identifiable information to any third party without permission, unless required to do so by law.

Access to, changing or removing information

Registered users of Zappa sites can update information or change settings only by emailing us at hello@zappa.ie

Registered users can cancel their membership by contacting us at hello@zappa.ie

Non- registered and registered users of Zappa sites can request a copy of the personally identifiable information held via Google. You may ask Zappa to make any necessary changes to ensure that such information is current and accurate.

Cookies and tracking

Like many websites, Zappa uses "cookies" to personalise your visits to its Sites to simplify the signing-in procedure, and to track your preferences and usage of the websites. Cookies are small pieces of information your browser stores in the hard-drive of your computer. Your browser has the option to prevent websites using cookies (your browser's help screen or manual explains how to do this). NB; using the option to prevent cookie usage may reduce the functionality of Zappa sites and other websites.

Like all websites, Zappa’s servers automatically record 'log files' containing information about the volume and characteristics of our website traffic e.g. IP address, numbers of pages viewed, length of time spent on site. Zappa uses log files to build pictures of site usage, which helps monitor and improve the service. Zappa cannot identify you from your log files.

Zappa uses third party advertisements on its sites as additional support. Some advertisers may use technology such as cookies and web beacons when they advertise, which will also send these advertisers (such as Google through the Google AdSense program) information including your IP address, your ISP, the browser you used to visit our site, and in some cases, whether you have Flash installed. This is generally used for retargeting purposes (showing London properties for someone in the UK, for example) or showing certain ads based on specific sites visited (for example, cooking ads to someone who frequents cooking sites).

DoubleClick DART cookies

We also may use DART cookies for ad serving, through Google's DoubleClick ad server. This places a cookie on your computer when you browse the web and visit a site using DoubleClick advertising (including some Google AdSense advertisements). The cookie serves ads specific to you and your interests ("interest based targeting"). They are based on your previous browsing history (For example, if you have been viewing sites about visiting Paris, you may see Paris hotel advertisements when viewing a non-related site).

DART uses "non-personally identifiable information". It does NOT track personal information about your name, email address, physical address, telephone number, social security numbers, bank account numbers or credit card numbers.

Security, storage and transfer of information

We follow strict security procedures to prevent damage or destruction of your personal information. Our procedures also prevent unauthorised access to or disclosure of information to any third party without your permission (unless they are providing services as outlined in the 'who has access to your information' section above).

Computers storing your information are kept in a secure facility with restricted physical access, and use secure firewalls and other measures to restrict electronic access. When working with third parties, we demand similar measures to protect your information. All information we collect or record is restricted to our offices. We explicitly ask when we need information to identify you. We may require you to co-operate with our security checks before disclosing information.

You can update the personal information that you give us at any time by viewing your details page. We retain your information for a reasonable period or for as long as is required by law.

Anti-Spam Policy

This Anti-Spam Policy Notice governs the use of Zappa sites along with all associated services, web pages, domains and sub-domains, owned and operated by Zappa. Zappa sites must not be used as a database for direct marketing by phone or SMS messaging or email or by any other form of electronic mail. The personal contact details contained in the placements on the sites are for the sole purpose of letting or selling a property. They may not be used for any other purpose. Sending unsolicited direct marketing electronic mail or making unsolicited marketing phone calls is, in certain circumstances, prohibited by law, and may give rise to fines and/or other penalties.

Zappa considers spamming to be any activity which includes directly or indirectly transmitting electronic mail to any person that has not solicited such electronic mail and does not consent to such transmissions. Zappa also considers spamming as the posting of advertisements that are off topic, or in the discussion forum.

Zappa reserves the right to terminate any account deemed in violation of our anti-spamming policies.

Zappa also reserves the right to suspend any account pending review, upon receipt of any complaint or other evidence of engagement in any spamming activity.

Anonymous and aggregated data

Zappa may aggregate data anonymously for disclosure to advertisers or business associates for promotion and marketing purposes. For example; Zappa may disclose to an advertiser the number of unique visitors to its sites, or the percentage age groups of its members. Zappa undertakes to ensure that such data cannot be used for personal identification.

Sale of the Company

Zappa reserves the right to transfer information, including personal data, to a third party in the event of its sale, merger, liquidation, receivership or transfer of all or substantially all of its assets provided that the third party agrees to adhere to the terms of this Privacy Statement, and provided that the third party only uses your Personal Data for its original purpose. Zappa will notify you in the event of any such transfer, affording an opportunity to opt out.

Zappa Comments Policy

The Zappa Web Site is an online information service provided by The Jaybak Web Agency. The site has a discussion forum where site users can create and participate in discussions using text, links, profiles, audio, pictures, video and other media (hereinafter referred to as "Material") as appropriate.

Non-Commercial Use

The Forum is made available for personal, non-commercial use only, except where otherwise authorised by Zappa.

Account

Your Liability

Please note that you are liable for the contents of any Material you post on the Forum. Zappa accepts no liability for any Material posted on the Forum by users. Any views or comments expressed in user posts are not necessarily the views of Zappa, any entity associated with it or any of its employees or agents.

Zappa is not responsible for, and does not endorse the contents of user's posts or warrant their accuracy, truthfulness, legality or reliability. You are entirely responsible for your Material. You agree to fully indemnify Zappa in the event of any legal proceedings being brought against Zappa, in consequence of your posting Material. For clarity, the indemnity you give Zappa is effective in respect of any and all legal proceedings including any and all possible causes of action that may result from any breach of the Web Site Agreement, the Comments Policy and/or applicable law.

Your identity

Exercise discretion when providing personal information on the Forum. Any personal information which you volunteer in your public profile or post on the Forum will be available worldwide to anyone with access to the website.

We recommend you do not post your name, address, telephone number email address or anything that may lead someone to identify you.

Please note that certain information might reveal your gender, ethnic origin, nationality, religion and/or sexual orientation.

Zappa reserves the right to reveal your identity (or relevant information) in the event of a complaint or legal action arising from any Material posted by you.

Prohibited Material

We expect you to act responsibly in posting Material on the Forum. You are not permitted to:

Zappa is not required to monitor and/or review the contents of posted Material, nor does it confirm the validity of information submitted. Accordingly, Zappa is not responsible for and gives no warranty or representation in relation to Material posted by users.

To the fullest extent permitted by law, Zappa does not accept any liability for the following;

  1. any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of or in connection with the use of or inability to use the Forum, or arising out of or in connection with any information or transactions provided on the Forum, or downloaded from the Forum, or arising out of or in connection with any delay in such information or service, even if Zappa or its authorised representatives have been advised of the possibility of such damages,

  1. any claim attributable to errors, omissions, or other inaccuracies in the Forum and/or Materials or information downloaded through the Forum.

Abuse

Zappa encourages you to bring any Material you deem offensive or objectionable or otherwise illegal to its attention by emailing hello@zappa.ie, or by using the Report Post Feature, identifying the specific Material you consider objectionable.

If another user defames, abuses, harasses, stalks, or threatens you, or otherwise violates your rights on the Forum, please report the post immediately by emailing Zappa hello@zappa.ie, identifying the specific Material you consider objectionable.

Waving the Red Card

Whilst we do not monitor Material posted by users, we reserve the right to take down Material that comes to our attention via a complaint or otherwise.

Users who repeatedly flout this Comments Policy or our Web Site Agreement will be barred from joining discussions on The Forum. If we have to remove Material posted by you on three occasions, you will be blacklisted. You will not necessarily be notified when Material is removed.

Zappa will not enter into any correspondence with or about users who have been blacklisted. Furthermore, Zappa reserves the right to immediately ban a user if there has been a serious breach of the Comments Policy or the Web Site Agreement. All decisions related to these matters are carried out at the sole discretion of Zappa.

Intellectual property

By posting any Material on the Forum, you grant Zappa licence to use, modify, publicly perform, publicly display, reproduce, and distribute such Material whether on the Site, any other site or otherwise. The licence you grant to Zappa is non-exclusive, royalty free and fully paid, sub-licensable, and worldwide. You also waive to the fullest extent permissible by law any moral rights in such Material. You are responsible for ensuring you have all rights to what you post, including the rights necessary for you to grant the licence above.

By posting any Material on the Forum you represent and warrant that:

  1. You own the Material posted by you, or otherwise have the right to grant the licence above.

  1. Posting the Material does not violate the privacy rights, publicity rights, intellectual property rights, confidentiality, contract rights or any other rights of any person, or is not otherwise illegal.

You agree to pay all royalties, fees, or any other monies owing any person by reason of any Material posted by you to or through the Forum.

Withdrawing Your Material

Do not post any information you are not happy to leave up indefinitely. 
To ensure that threads and conversations are not disrupted, we generally leave uploaded Material, unless otherwise required by law. Therefore, you agree that your Material displayed on the Forum may continue to appear on the Forum, even after you have terminated your user privileges or have had your user privileges terminated by Zappa.

We cannot guarantee that other users will not use your ideas or information. Therefore, do not post ideas or information on the Forum that you would like to keep confidential and/or don't want others to use. Zappa cannot accept responsibility for a user's misuse or misappropriation of any content or information posted on the Forum.

Defamatory Content

Zappa operates a "notice and takedown" policy. Please notify Zappa immediately of any content on the Forum which contains a defamatory or illegal statement by emailing hello@zappa.ie, or by using the Report Post feature. On receipt of this information Zappa will use all reasonable endeavours to remove the defamatory content within a reasonable period of time.
